1. Scope
Deliveries, services and offers are made exclusively based on these terms and conditions, even if they are not expressly agreed again. When you order the goods or services, these conditions are deemed to have been accepted. The buyer's general purchasing conditions are hereby contradicted.
Deviations from these terms and conditions are only effective if we confirm them in writing. seyes AG can change the terms and conditions at any time. The version published at the time of the order is binding.

2. Offer and conclusion of contract
The offers in price lists and advertisements are subject to change and non-binding. The information in our sales documents (drawings, illustrations, dimensions, weights, and other services) are only to be understood as guidelines and do not constitute a guarantee of properties, unless they are expressly stated in writing as binding. The offer is valid as long as it is offered as such or is visible in the online shop and/or as long as there is stock. Price and range changes are possible at any time.

2.1 The presentation of the products [in the online shop] does not constitute a legally binding offer but rather an invitation to the customer to submit a binding order (offer to conclude a contract).
2.2 By clicking the order button, the customer submits a binding order for the products listed on the order page.
2.3 Immediately after receiving the order, the seller confirms receipt of the order via email. The purchase contract is only concluded when the seller confirms the dispatch of the goods via email (order or dispatch confirmation) or, at the latest, upon delivery of the goods.
2.4 In the case of payment in advance, the purchase contract is concluded upon confirmation of the receipt of the prepayment by the seller.

3. Prices
A: Deliveries in Switzerland
The prices listed, if in Swiss francs, include VAT of 8.1% excluding delivery.

B: Deliveries in the EU area is free of charge

All prices in euros, always in the VAT of the country of delivery. The delivery in Germany/Spain/Italy and Austria is *free. Other EU countries please inquire.

*The delivery is free of charge for orders over €50, up to a weight of 3kg. For quantities exceeding 3kg, costs may be shared (to be mutually agreed upon).

4. Shipping
The respective shipping costs are displayed in the shopping cart. We reserve the right to limit the delivery quantities for certain products or not to carry out the delivery. We deliver as quickly as possible via parcel service, or freight forwarder – usually within a few days. But remember that our products are not mass-produced items. We will not always be able to avoid longer delivery times. There is no obligation on our part to procure.

You can return the items within 14 days of delivery – only unused, in perfect, salable condition and in our original packaging. We reserve the right to demand reasonable compensation for damage, excessive wear and tear or loss of value due to improper handling and to deduct the loss of value from the purchase price already paid.

6. Warranty
In any case, we stand by the products in our range: we ensure that your warranty
claims are fulfilled and that we provide careful service for two years from the invoice date. Obvious defects, including transport damage, must be reported to us
immediately upon receipt of the delivery. Hidden defects and defects that only appear later must also be reported to us immediately after they are discovered. At our discretion, we will correct the defects free of charge or provide you with an equivalent replacement. If we cannot remedy the defects or provide a replacement within a reasonable period, you are entitled to reverse the purchase (conversion) or reduce the purchase price accordingly (reduction). Please have the goods ready for us.

7. Liability
Claims for damages, regardless of the legal basis (claims due to negligence in
contract negotiations, breach of secondary obligations, tort, and other legal claims) are excluded. We are not liable for damage that did not occur to the delivery item itself; In particular, we are not liable for indirect damage, lost profits, or other financial losses to the customer. Furthermore, any compensation for delayed deliveries is excluded. The exclusion of liability does not apply if damage was caused by grossly negligent or intentional actions on our part. Because our products are not mass- produced items, there may be slight deviations from the product images and information for which we are not liable. However, you can return such items - like all other items - within the 14-day period.

8. Retention of Title
The delivered goods remain our property until full payment has been made.

9. Data protection
To process your order, we store your address and order-related data. These can also be forwarded internally to other contractual partners at home and abroad as part of order processing become. Your data will be treated confidentially and will not be passed on to third parties unless this is necessary for order processing (e.g. logistics service providers, credit check). Your rights under Swiss data protection are guaranteed.

10. Image rights
All image rights are the property of Seyes AG. Use without express permission is
prohibited.

11. Applicable Law and Place of Jurisdiction
Basel is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship. The legal relationship is subject to Swiss law.
